LE CIEL JOURNAL · FOR PROPERTY OWNERS
Before the first welcome message, there is a quieter kind of preparation: knowing that the property and operating arrangement have been properly checked. Indonesia rental property compliance deserves the same care as the interiors. Start with clear questions, written answers and responsibilities that everyone understands.
At a glance: Indonesia rental property compliance starts with the actual activity and address. Review business licensing, property use, building rules and contractual responsibilities with the appropriate authorities and advisers.
Indonesia rental property compliance depends on the activity, the operator, the location and the building. There is no useful one-line answer that covers every apartment, villa and guesthouse.
Understand what an NIB does—and what still needs checking
Get the operating arrangement clear
The official OSS business licensing portal describes the Nomor Induk Berusaha, or NIB, as a business identity. It also explains that risk-based licensing determines the permissions and obligations an activity must meet. Do not treat an NIB as proof that every planned use of every property is authorised.
Check the current business classification and applicable requirements in OSS with a qualified local adviser or the relevant authority. Avoid copying another owner’s business code: a different activity or operating arrangement can change the analysis.

Zoning in Bali: can this exact property accommodate short-term guests?
Check the parcel and the proposed use before accepting bookings. A valid company NIB, an appropriate KBLI and a signed management contract do not override land-use restrictions. Confirm that the intended short-term accommodation activity is permitted at the exact location, fulfil any conditions, and obtain the required spatial and operational approvals.
The articles’ general planning checks also apply in Bali. Do not assume that a residential house can automatically become tourist accommodation. In its official May 2025 inspection report, Badung’s government specifically addressed residential premises being commercialised as tourist accommodation and called for alignment of their designated use and permits.
- Identify the site precisely. Prepare the full address, parcel boundaries or coordinates, land/lease documents and an honest description of the operation: nightly or weekly stays, property type, capacity and services. The official OSS KKPR–RDTR guide links the location polygon and business activity to the spatial review.
- Check the applicable plan. Start with OSS RDTR Interaktif. For Badung properties, consult the DPUPR Badung RDTR resources. Ask the relevant regency/city planning office which enacted RDTR and zoning provisions currently apply; do not rely on a draft revision or assume another district’s rules apply.
- Read the activity rules, not just the map colour. Bali’s official explanation of the ITBX zoning framework distinguishes permitted (I), limited (T), conditional (B) and prohibited (X) uses. Check the exact accommodation activity and all relevant conditions. A “tourism”, “residential”, “pink” or “yellow” label alone is not an approval. Ask about applicable agricultural/protected-land, sacred-area, coastal or river-setback restrictions.
- Complete the applicable spatial procedure. Ask OSS and the competent DPMPTSP/spatial-planning authority which KKPR route or other applicable spatial-compliance document is required for your operator and site. If no relevant integrated RDTR is available, request the correct assessment route; absence of an online map does not mean unrestricted use. Keep the issued document, its activity/location scope and conditions.
- Match the building and operational permissions. Confirm that the authorised building function and applicable PBG/SLF, environmental and accommodation requirements support the actual use. Obtain any required changes before operating. Neighbouring listings, OTA acceptance or an informal assurance do not replace these checks.
For Le Ciel-managed properties: record the zoning outcome and supporting documents in the property file. If the proposed use is prohibited, do not launch it; if it is conditional, resolve and document the conditions first. Le Ciel’s valid business registration and the management contract cannot make a prohibited location eligible.

Prepare a property-specific question list
- Who operates the accommodation? Clarify the owner, business operator and manager’s roles. A management agreement does not automatically transfer every legal responsibility.
- What activity is planned? Explain the actual accommodation type, services and length of stays. Ask which current business classification and licensing requirements apply.
- Is the property suitable for that use? Ask the relevant local offices about permitted use, planning and building requirements for the particular address.
- What does the building allow? For an apartment, obtain and read the building’s rental and guest-access rules. Platform acceptance does not replace building approval.
- What ongoing duties apply? Ask about applicable taxes, reporting, guest records, safety and renewals. Request the basis for the answer rather than relying on an informal assurance.
Keep the answers and documents together
Create a folder containing the documents relevant to your actual arrangement, written authority responses, building rules and adviser notes. Record issue dates, review dates and who follows up. Give the property manager access to what they need while protecting personal and guest information.
If an answer is unclear, pause the affected activity until it is resolved. A listing going live is not a legal approval, and the same advice should not be assumed to apply across Jakarta, Surabaya, Bali and other locations.
Build an Indonesia rental property compliance file
Think of the file as a record of decisions for one address and one operating arrangement. It should explain who is providing accommodation, what activity is planned and which documents support that activity. Another property’s folder is a reference for questions, not a substitute for your own review.
Write a short operating brief first
- The full property address, property type and ownership or lease arrangement.
- The proposed operator and the manager’s actual role.
- The intended stay lengths, guest capacity and services.
- Shared building facilities and how guests will access them.
- The planned payment flow, booking channels and record-keeping responsibilities.
Give the same brief to the relevant adviser, authority and building management. This reduces the risk of receiving answers based on different assumptions. Keep written responses together with the documents they refer to.
Check four layers before opening the calendar
1. The business activity
Ask which current classification and licensing pathway match the actual operation. Use the live OSS information. Record who owns the registration and which property or activity it covers.
2. The property and location
Ask the relevant local authority about the address and intended use. Identify unresolved planning, building or operational questions. A platform’s acceptance of a listing does not resolve them.
3. The apartment or estate rules
Request the current written rules about rentals, visitors, registration and shared facilities. Identify the person authorised to clarify them. A verbal assurance from someone without that authority may not settle a later dispute.
4. The contracts and ongoing duties
Check the owner-manager agreement alongside the actual payment and operating flow. Ask a suitable professional which tax, reporting and record obligations apply. Do not assign obligations by guesswork.

Indonesian owners and foreign investors: when is a PT PMA needed?
Foreign investment in an Indonesian rental or accommodation business generally requires a PT PMA—an Indonesian limited liability company with foreign investment—unless a statutory exception applies. This follows Article 5(2) of Law No. 25 of 2007 on Investment. Indonesian domestic investment may use an eligible individual business or domestic business entity; it does not require a PT PMA merely because the property welcomes foreign guests.
Distinguish holding lawful property or lease rights from investing in and operating a rental business. Nationality alone does not settle the licensing question. A foreign owner’s rights, rental arrangement, commercial role and tax position need individual review. Appointing a manager is not an automatic exemption from foreign-investment requirements, and neither a PT PMA nor a management contract grants unrestricted land-ownership or work rights.
For a PT PMA, prepare the following with an Indonesian notary and the relevant licensing adviser:
- Confirm that the actual business activity is open to foreign investment and identify the applicable KBLI classification and ownership conditions.
- Prepare the incorporation deed and legal-entity approval, shareholder and beneficial-owner information, business address and tax registration.
- Arrange the required capital and investment plan, then obtain the company’s own NIB through OSS and fulfil the risk-based licences or standard certificates applicable to the activity and location.
- Check lawful property-use rights, spatial and environmental requirements, building approvals such as PBG/SLF where applicable, building-management rules, and ongoing tax and investment-reporting obligations.
Capital is not the same as project investment. Article 26 of Minister of Investment/BKPM Regulation No. 5 of 2025 sets a general minimum paid-up/issued capital of IDR 2.5 billion per PT PMA, unless otherwise prescribed. The general investment threshold is more than IDR 10 billion per five-digit KBLI per project location, normally excluding land and buildings. Accommodation and property activities have specific calculation rules, including cases where land and buildings count and different treatment for individual property units. Have the precise calculation and any transitional provisions checked; these figures are not incorporation fees.
Working with Le Ciel: a signed contract and a verified operating structure
Indonesian citizens and foreign owners with lawful rights over their property can ask Le Ciel Hospitality (PT Langit Biru Luxindo) to assess a management or operating arrangement. A written contract with PT Langit Biru Luxindo is required before any agreed use of the company’s business identity. Acceptance remains subject to the property documents, the company’s actual registered scope and the permissions required for the proposed operation.
What “using Le Ciel’s NIB/KBLI” can mean: PT Langit Biru Luxindo conducts the activities it is legally authorised to perform under its own business identity and the agreed contract. The NIB remains the company’s identity; a KBLI is an activity classification, not a licence that an owner can borrow. Signing a contract alone does not authorise an owner’s separate business or every property.
The key distinction is whether Le Ciel provides management/marketing services for an owner who remains the accommodation operator, or whether PT Langit Biru Luxindo itself becomes the lawful accommodation operator. In the first case, the operator’s own licensing obligations remain. In the second, the company’s accommodation activity and each relevant location must be covered by the required registrations, certificates and approvals. This is a property-specific assessment, not a blanket permission established by this article.
- Le Ciel’s business registration: Le Ciel confirms that PT Langit Biru Luxindo holds a valid NIB and correctly registered KBLI activities. Before activating each property, confirm that the agreed operation falls within that registered scope and that the relevant OSS project/location records, zoning and operational permissions are in place.
- In the contract: identify the property and lawful rights, actual operator, services and authority, fees, booking/OTA arrangements, invoicing, payouts, taxes, guest records, safety duties, insurance responsibilities and termination arrangements.
- For both WNI and WNA: a contract does not cure prohibited property use or remove obligations that the law places on the owner or operator. For foreign owners, separately confirm whether their own investment activity requires a PT PMA.
Direct OTA payouts to an owner do not, by themselves, establish who the lawful operator is or remove tax obligations. The contract, platform records, invoices and actual operation must be consistent. The legal basis for the distinction is the entity-specific NIB framework in Article 16 of Regulation No. 5 of 2025 and the risk-based licensing system under Government Regulation No. 28 of 2025; neither is a general “licence-sharing” exemption.
To discuss the appropriate structure, send Le Ciel your property details. The operating scope and responsibilities should be confirmed in writing before bookings begin.
Official references reviewed: 10 October 2026. General information; the applicable structure must be assessed against the actual documents and current OSS requirements.
Do not treat a manager’s NIB as blanket property permission
If a proposal involves using a management company’s business identity, ask how that arrangement works legally for this activity and address. Request a written explanation of roles, authority, invoicing and payment flow. An agreement should describe responsibilities rather than imply that one registration automatically authorises every owner and property.
Where the answer depends on documents not yet available, leave the point open and assign a follow-up. It is better to identify the missing evidence before accepting guests than to discover conflicting responsibilities after a complaint.
Make the file useful after launch
For each document, record its issuer, scope, relevant dates, responsible person and next action. Review the arrangement when the operator, property use, services or ownership changes. Keep personal and guest information accessible only to people who need it for their role.
Frequently asked questions
Questions before you start
Does every rental need the same documents?
No universal list in this article determines that. Indonesia rental property compliance must be checked for the activity, location and operating structure.
Can I copy another owner’s classification?
Use it to frame a question, not to choose a code. Confirm the current classification for your own activity with the appropriate adviser or authority.
Keep Indonesia rental property compliance connected to the actual operation. Written answers and assigned follow-ups make the file useful when circumstances change.
Discuss compliance responsibilities before management starts
Ask which documents the manager checks, what they can help coordinate and what remains with the owner or a specialist. Put those responsibilities into the agreement. Do not assume a hospitality team provides legal representation, tax advice or guaranteed permit approval.
Introduce your property to Le Ciel with its location, type and intended use, or ask about the onboarding process. Use this article to prepare a discussion, not as a determination of your property’s legal status. Requirements can change; verify them with current official guidance before acting.
